Bill to Pull Plug On NSA Introduced in Texas

Legislation would Turn Off Water and Electric to San Antonio Facility
A Texas legislator introduced a bill that would stop the independent Texas power grid from being used to power mass, warrantless surveillance by the NSA last week.
Rep. Jonathan Stickland (R) introduced House Bill 3916 (HB3916) on March 13. The legislation would prohibit any political subdivision in Texas from providing water or electricity to any federal agency "involved in the routine surveillance or collection and storage of bulk telephone or e-mail records or related metadata concerning any citizen of the United States and that claims the legal authority to collect and store the bulk telephone or e-mail records or metadata concerning any citizen of the United States without the citizen's consent or a search warrant that describes the person, place, or thing to be searched or seized."
"No water and no electricity means no super-computers. That will shut down NSA operations in Texas. If Congress doesn't want to reform the NSA then we'll just turn it off," OffNow founder and associate director Michael Boldin said.
IMMEDIATE EFFECT
If passed, HB3916 would ultimately turn off water and electric service to the massive Texas Cryptologic Center in San Antonio.
In 2006, the Baltimore Sun reported that the NSA had maxed out capacity of the Baltimore-area power grid via Baltimore Gas and Electric. Insiders reported that, “The NSA is already unable to install some costly and sophisticated new equipment. At minimum, the problem could produce disruptions leading to outages and power surges. At worst, it could force a virtual shutdown of the agency.”

This, in part, led the NSA to expand to new locations in states such as Utah and Texas, to ensure that the agency could keep expanding its programs without the risk of shutting down due to lack of resources.
A former Sony warehouse, just down the road from a new Microsoft data center, houses the San Antonio NSA facility. According to the Houston Chronicle, Corporate Office Properties Trust (COPT), a publicly traded company based in Maryland, owns the property and leases it to the NSA.
The federal government keeps the Texas Cryptologic Center shrouded in secrecy. According to the Houston Chronicle story, "Longtime observers of the intelligence agency say they believe the San Antonio plant has a mission similar to the agency's other new facilities in Georgia and Hawaii, where communications intercepted by NSA are translated and then sent to headquarters in Maryland for analysis."
“No longer able to store all the intercepted phone calls and e-mail in its secret city, the agency has now built a new data warehouse in San Antonio, Texas,” writes author James Bamford in the Shadow Factory, his third book about the NSA. “Costing, with renovations, upwards of $130 million, the 470,000-square-foot facility will be almost the size of the Alamo Dome. Considering how much data can now be squeezed onto a small flash drive, the new NSA building may eventually be able to hold all the information in the world.”
City-owned CPS Energy provides electric service to the facility. According to the company website, it counts as the United States’ largest municipally owned utility company, with combined natural gas and electric service. It remains unclear exactly what entity supplies the center's water, but the San Antonio Water System provides water service to most of San Antonio.
Passage of HB3916 would prohibit both companies from supplying resources to the NSA facility.
LEGALITY
HB3916 rests on a rock-solid legal doctrine. The Supreme Court has repeatedly upheld the principle that the states cannot be required to supply resources or manpower to help the federal government carry out its acts or programs.
Known as the anti-commandeering doctrine, the legal principle rests primarily on four Supreme Court opinions dating back to 1842. In Prigg v. Pennsylvania (1842), Justice Joseph Story held that the federal government could not force states to implement or carry out the Fugitive Slave Act of 1793. He said that it was a federal law, and the federal government ultimately had to enforce it.

The fundamental principle applicable to all cases of this sort, would seem to be, that where the end is required, the means are given; and where the duty is enjoined, the ability to perform it is contemplated to exist on the part of the functionaries to whom it is entrusted. The clause is found in the national Constitution, and not in that of any state. It does not point out any state functionaries, or any state action to carry its provisions into effect. The states cannot, therefore, be compelled to enforce them; and it might well be deemed an unconstitutional exercise of the power of interpretation, to insist that the states are bound to provide means to carry into effect the duties of the national government, nowhere delegated or instrusted to them by the Constitution.
Other key cases include New York v. United States (1992), Printz v. United States (1997), and Independent Business v. Sebelius (2012).
“State governments are free to refrain from cooperating with federal authorities if they so choose. In general, states cannot attack federal operations, but that’s not the same as refusing to help,” Noted Constitutional scholar Randy Barnett of Georgetown Law said.
WHAT’S NEXT
In practice, HB3916 would prohibit state or local-owned utilities from supplying water or electric service to NSA facilities in the state. The bill does include a provision allowing for the municipality to repay any bonds payable from pledged revenue from water or electric service before discontinuing such service. A political subdivision would be able to fulfill any contractual obligations currently in place, but could not extend any contracts.
Passage into law would be a powerful step towards ending the bulk, warrantless surveillance of all electronic communications.
HB3916 will first be assigned to a House committee, where it will need to pass by majority vote to move forward.

The City of San Diego and the San Diego Unified Port District filed suit against chemical giant Monsanto Monday for polluting the city’s bay and tidelands.

According to the lawsuit, Monsanto knowingly hid the well-documented health issues linked to polychlorinated biphenyls, commonly referred to as PCBs, in order to continue using compounds such as Aroclor.

“PCBs manufactured by Monsanto have been found in Bay sediments and water and have been identified in tissues of fish, lobsters, and other marine life in the Bay,” the complaint reads. “PCB contamination in and around the Bay affects all San Diegans and visitors who enjoy the Bay, who reasonably would be disturbed by the presence of a hazardous, banned substance in the sediment, water, and wildlife.”

As noted by the San Diego Reader, internal Monsanto documents reveal the company has been well aware of the risks associated with PCBs for years.

“There is little probability that any action that can be taken will prevent the growing incrimination of specific polychlorinated biphenyls as nearly global environmental contaminants leading to contamination of human food (particularly fish), the killing of some marine species (shrimp), and the possible extinction of several species of fish eating birds,” the document states.

If the lawsuit is successful, the city, which was also sued in 2012 for polluting the San Diego bay, hopes to use the much needed funds to increase the chemical cleanup budget.

“In 2012, the San Diego Regional Water Control Board found the city and port responsible for pollution of San Diego Bay, namely in what has become known as the Shipyards Sediment Site,” the San Diego Reader article states. “In 2014, the City of San Diego agreed to pay $949,634 in fines for permitting the dumping of hazardous chemicals into the bay. The city also allocated $6.45 million to clean the Shipyards Sediment Site.”

Regardless of the lawsuit’s outcome, the revelation will likely only serve to further dismantle Monsanto’s hemorrhaging popularity among the public.

In fact, a 2014 Nielsen poll found the agricultural giant to be the third most-disliked company in America, an unsurprising discovery given the company’s $156 million fourth quarter loss from last year.

The latest US Geological Survey published in the journal Enviromental Toxicology and Chemistry also found that 75 percent of rain and air samples collected in Mississippi in 2007 were contaminated with the company’s infamous Roundup herbicide.

President Obama late Saturday joked about the controversy surrounding former Secretary of State Hilary Clinton’s use of a private email account during a white-tie dinner in Washington, D.C.

According to a White House pool report, Obama told guests at the Gridiron Club dinner that he was once known as the young, tech-savvy candidate.

But now, “Hillary has a server in her house! I didn’t even know you could have one of those. I am so far behind.”

Vice President Joe Biden was also the target of several jokes.

“Joe rubs my shoulders, too,” the president said. “It’s not bad. It feels pretty good. I don’t let him give me a pedicure, but…”

Obama also took a shot at Wisconsin Gov. Scott Walker (R), a potential 2016 GOP presidential candidate, who was among dinner guests ranging from baseball great Hank Aaron to MSNBC’s Chris Matthews.

Obama said that Walker “punted on the question of evolution, which I do think is a problem. I absolutely believe in the theory of evolution – when it comes to gay marriage.”

The president also said a letter to Iran’s leaders signed by 47 Republican senators “wasn’t a joke.”

“You don’t diminish your office by taking a selfie. You do it by sending a poorly written letter to Iran. Really. That wasn’t a joke.”

And Obama’s response to New York Mayor Rudy Giuliani’s (R) comment that he didn’t love America drew big laughs.

“If I did not love America, I wouldn’t have moved here from Kenya,” Obama said.

At first glance...there is nothing we haven't heard here. So what? Just another bankster who mad a bad boo-boo and now will have to pay a fine.

Of course, the Derivative Bubble won't pop unless SOMETHING happens in the real world so Deutsche Bank has no worries at all...right? It's not like they are invested in any areas that are struggling...are they? It's not like they don't know what's going to happen in Greece, Italy, Spain...etc. They must be long gone from those risky countries - Right?

The family of a naval veteran was pleasantly surprised after the bill for a recent meal came back paid in full.

Last month, 92-year-old WWII vet Bob Nieman and his family celebrated his birthday at their local Outback Steakhouse restaurant in Sebring, Florida.

Upon completion of the meal, Bob’s son, also named Bob, says their waiter informed them that another customer had picked up the tab.

“I wheeled my dad in & sat him down as I usually do,” the younger Bob described in a statement toOpposing Views.

“I noticed this 1 couple across from us watching [and] 10 minutes later they were gone. Thinking no more about it we started offing our food with the waiter as we were doing so he said to all of us, ‘Don’t Worry about the bill it’s already been taken [care] of because of this man service to our country.’ My dad was at the time wearing his Lexington Hat like he always does started beaming from ear to ear. My mom asked who did this & the waiter said, ‘Don’t worry they already left but they wanted to make sure you all were taken care of.’ Me being the ex-cop I am had to know and pressed him some more. ‘It wasn’t the couple sitting at that table?’ I asked, ‘the couple I noticed earlier?’ He told me yes, it was…how did I know? ‘Just a good guess, I said.’”

Nieman served as plankowner on the USS Lexington CV 16 during the second World War “and was taken off by a medical ship in 1944 when he was the only surviving member of his gun crew that was not killed by a Kamikaze that hit his gun turret,” according to Nieman’s son, who also provided photos of his father.

Second Amendment Activists Force ATF To Shelve Obama Ammo Ban

The ATF says it is shelving a proposed ban on ‘green tip’ ammunition after a deluge of critical feedback, highlighting that the move would be highly unpopular with Americans.

The federal agency said Tuesday that the President’s planned executive action to prohibit bullets for AR-15 hunting rifles will not go ahead. The ATF says that over 80,000 comments were received on the proposal. Most viewed the move negatively.

“The vast majority of the comments received to date are critical of the framework, and include issues that deserve further study,” the agency said in a statement. “Accordingly, ATF will not at this time seek to issue a final framework.”

The agency took to social media, declaring “You spoke, we listened.” The public comment period still had another week to run, and was to end Monday.

The ATF added that it will “further evaluate the issues raised” during the comment process, and that it will provide an “additional open and transparent process” before taking any further action. However, it did not explain would that would entail.

The announcement comes directly on the heels of a majority in both the Senate and House, 52 senators, 238 House members, declaring their opposition to the proposed ban.

In a letter, the senators cited the fact that the 5.56 M855 ammo has never been perceived to be a threat to law enforcement, and is merely popular in hunting circles.

The lawmakers also expressed a fear that the Obama administration is paving the way for a more general gun control agenda.

“If law-abiding gun owners cannot obtain rifle ammunition, or face substantial difficulty in finding ammunition available and at reasonable prices because government entities are banning such ammunition, then the Second Amendment is at risk,” the letter signed by the senators states.

Gun rights activists and Constitutionalists hailed the government back down as a victory.

“The strength of people who support and take their Second Amendment rights seriously has never been stronger,” said Larry Keane, senior vice president of the National Shooting Sports Foundation. “I frankly don’t think ATF had much choice in the matter. It was clear that Congress was not going to let it go forward.”

“Today’s announcement proves what we have said all along — this was 100 percent political,” said Wayne LaPierre, executive vice president of the National Rifle Association. “Obama failed to pass gun control through Congress, so he tried [to] impose his political agenda through executive fiat.”

“This is a win for not only America’s gun owners, but everyone who supports the Constitution, because if the president can undermine a fundamental freedom such as this, then he can undermine anything.” added Chris Cox, NRA executive director.

Senate Committee on the Judiciary Chairman Chuck Grassley added “ATF’s original proposal to short-circuit the exemption and limit access to rifle ammunition was an affront to the Second Amendment to the Constitution.”

As Infowars previously reported, The ATF was forced to issue an apology this week for angering Americans by intimating that there is already a ban in place on AR-15 ‘green tip’ ammo.

An online regulations guide failed to list .223-caliber ammo as currently exempted from a ban on armor piercing ammunition, meaning that it was purposefully removed from previous versions of the document, possibly with the proposed ban in mind.

Senator Rand Paul has called for an independent investigation into Hillary Clinton’s email scandal, charging that the Clintons think they are above the law.

“I don’t think the Clintons should be above the law,” said Paul during an appearance on The Kelly File, adding that Hillary’s excuse that she was using a personal email account for “convenience” shouldn’t trump national security.

Later in the interview, Paul charged that Clinton operated out of arrogance in thinking that, “some of these laws apply to lower people and not to me, Hillary Clinton….nobody should be above the law in our land.”

The former of Secretary of State appeared at a hastily arranged press conference yesterday during which she repeated claims that none of the roughly 30,000 emails that were “deleted” from her personal email account were related to official business.

“I don’t see how she can do this email back and forth with the President, how can she email from Libya about worldwide events and expect that those conversations – none of them – were classified,” said the Senator as he called for an independent investigation into the scandal.

Paul cited photographs of Hillary Clinton using her phone during trips to LIbya, images which don’t correlate with Rep. Trey Gowdy’s finding that there were “gaps of months, and months and months” in email logs that Hillary had handed over from that time period.

“Can we trust Hillary Clinton to produce all of her email when we couldn’t trust her to obey the law that she had to use a State Department email? The only way we get to the truth is through an independent investigation and I do believe that public opinion can provoke that,” said the Senator, adding that the American public “should not tolerate” Clinton’s secrecy.

Asked whether directions given by Hillary to other State Department officials asking them to avoid using personal email accounts meant Hilary thought she was above the law, Paul agreed, before also touching on the millions of dollars her foundation has received from Middle Eastern countries known for oppressing women.

“This is a couple that have been raising money from foreign countries that have despicable human rights and women’s rights records and they’re somehow to be trusted? ‘Oh we’re taking $20 million dollars from Saudi Arabia, but it didn’t affect any of our policy’ – it’s unseemly and I think the American people will be kind of sickened to see this level of….to me it seems to be deception,” said Paul.

The Senator also speculated that there were a “whole host of conversations” undertaken by Hillary that would be deemed classified if anyone tried to obtain them through a FOIA request.
