Consent is sexy

The California state legislature is eagerly jumping into bed with college students but really killing the mood with some unsexy rules.

State Sen. Kevin de Leon (D–Los Angeles) has introduced a bill that would require state universities to set strict parameters on what constitutes consensual sex. According to the text of SB 967, the student initiating sexual contact must establish "affirmative consent," defined as:

an affirmative, unambiguous, and conscious decision by each participant to engage in mutually agreed-upon sexual activity. Consent is informed, freely given, and voluntary. It is the responsibility of the person initiating the sexual activity to ensure that he or she has the consent of the other person to engage in the sexual activity. Lack of protest or resistance does not mean consent, nor does silence mean consent.

Consent must be ongoing throughout a sexual encounter and can be revoked at any time. The existence of a dating relationship between the persons involved, or the fact of past sexual relations between them, should never by itself be assumed to be an indicator of consent.

The bill also explicitly lists several circumstances in which the initiator can be convicted of rape even after obtaining consent:

(A) The accused's belief in consent arose from the self-induced intoxication or recklessness of the accused.

(B) The accused did not take reasonable steps, in the circumstances known to the accused at the time, to ascertain that the complainant was consenting.

College administrators must use a "preponderance of the evidence" standard. If they determine that it was 50.0001 percent more likely than not that a sexual encounter violated one of the above conditions, they must find the offender guilty, according to the bill.

The bill also requires that universities provide resources and support to victims of sexual assault. It says nothing, however, about the rights of the accused. Given that many universities already violate due process by depriving accused students of their rights to attorneys, juries of their peers, and opportunities to cross-examine their accusers, it seems unlikely that California universities would interpret this bill as a call to adhere to the requirements of the Fifth and Sixth Amendments.

In a statement to LA Weekly, de Leon made clear that his bill is a response to the federal government's recent investigation into the sexual assault response practices of universities around the country:

The federal government is currently investigating 55 colleges and universities. Obviously, there is a problem. SB 967 will change the equation so the system is not stacked against survivors by establishing an affirmative consent policy to make it clear that only 'yes' means 'yes.'

Indeed, if SB 967 becomes law, the system will certainly not be stacked against the survivors.

As LA Weekly points out, some of the bill's requirements are already in effect under existing law. In California, it is already illegal to have sex with someone who is asleep or incapacitated. If students think they were the victims of assault, they should contact the police, who will investigate the matter under the same rules that apply to everyone: students and non-students alike.

A student indicted for rape by police authorities enjoys constitutional rights, however. A student indicted for rape by a campus judiciary might as well be facing the Spanish Inquisition.

As an example, consider the fate of Occidental College's John Doe, who was accused of rape even though written evidence firmly established that his accuser had consented to sex. The police cleared him, but campus administrators found him guilty anyway. He was expelled.

Colleges have already demonstrated that they are frequently incapable of fairly investigating these cases. Now that the legislature is pressuring them to put out, they are likely to do even worse.

And society moves one step closer to the kind of thing predicted in this famous Dave Chapelle skit.

TEL AVIV – For the last six months, U.S. officials have been conducting secret, back-channel talks with Hamas regarding arrangements for the new Palestinian unity government, BuzzFeed.com confirmed Wednesday

On May 22, WND was first to report on the recent secret U.S.-Hamas talks. Middle Eastern security officials told WND the U.S. held a clandestine meeting in mid-May in Egypt with Ghazi Hamad, the deputy foreign minister of Hamas.

The officials would not say whether the meeting was with a current member of the U.S. government or a former diplomat acting as a proxy for the Obama administration.

Messages were exchanged about Hamas’ intentions as part of a newly formed Palestinian unity government with the rival Fatah party, led by Mahmoud Abbas, the officials told WND.

Now BuzzFeed adds new details about the scope and duration of the alleged U.S.-Hamas talks.

The website quoted two senior diplomatic sources with direct knowledge of the talks stating the meetings were held the last six months between U.S. representatives and Hamas officials in Egypt, Qatar and Jordan.

The sources said discussions centered on a cease-fire with Israel and the Fatah-Hamas unity government, with the U.S. securing a Hamas pledge to continue to abide by the truce.

Secretary of State John Kerry recently affirmed the U.S. will cooperate with the new unity government.

Contacted by BuzzFeed, State Department deputy spokeswoman Marie Harf denied U.S-Hamas talks were held.

“These assertions are completely untrue,” Harf stated. “There is no such back channel. Our position on Hamas has not changed.”

Harf reiterated a statement she made at a press briefing on Tuesday.

“As you all know, Hamas is a designated foreign terrorist organization,” she said. “The United States does not and will not provide it assistance. Per longstanding U.S. policy, we do not have any contact with Hamas. No members of Hamas and no ministers affiliated with Hamas, as I said, are part of this government.”

It is rather simple in terms but powerful in implementation.  With people in political positions in this clique abusing their powers with impunity it is necessary for all other nations to be able to protect their citizenry and sovereignty from the fascist movement of this generation.
The way to do this is simple.  As our mothers and fathers taught us, we just close the doors to unwanted visitors. We cannot and do not need to allow foreigners and enemies into our homes creating divisiveness and eventually taking them over entirely in our stead.  The NO FLY ACCORD prevents the opening from occurring in the first place.  But we must be careful because the Globalist spit their venom on all of us at every opportunity.
With God’s help – and we know he is there watching us every second of the way – we will turn the corner and sprint across the finish line.  Let us pray that the Nations that join this noble accord move quickly and either sign this accord directly, or pass it through their legislation so that it is implemented for the safety of us all.  If we fail to act and do our duty to defend our rights, our families, our homes, our nations and our environment, we just might be looking at World War III.

Report listing consumer boycott activity sent to DHS fusion center.

Newly revealed documents obtained by the Partnership for Civil Justice Fund show that the federal government treats consumer boycotts and anti-Black Friday activism as a terrorist threat.

A leaked email reveals that Tom Wilkins, who serves as Executive Director of theIntelligence Fusion Division, Homeland Security Bureau, and is on the FBI-WFO Joint Terrorism Task Force, directed staff at the Washington DC fusion center to create a document notifying District Commanders of the “potential threat” posed by groups that planned to “disrupt retail activity” on Black Friday in 2011.

Wilkins directed federal agents to peruse a 30 page report circulated by the International Council of Shopping Centers (ICSC) which lists a number of “specific known threats,” including groups which encourage people to cut up their credit cards as a protestagainst debt serfdom, participants of “zombie walks” designed to embarrass shoppers in malls, people who organize free non-commercial street parties, and people who organize “Wildcat General Strikes” by boycotting stores or vowing to use no power or fuel for a period of 24 hours.

Posters with slogans encouraging shoppers to “buy local” or “do your shopping at a small independent merchant” were also included in the ICSC report circulated by Wilkins to federal officials. Occupy groups in general were also listed, notably those who circulated anti-war leaflets and material opposed to military spending.

“It is outrageous that counter-terrorism officials used their anti-terrorism authority and funding to “protect” corporate America from a consumer boycott. It is well past time that the vast flow of tax-payer money to the Fusion Centers be ended,” said PCJF Executive Director Mara Verheyden-Hilliard.

Anti-Black Friday activism has become a staple of many activist organizations that span the political spectrum. Infowars itself routinely covers Black Friday madness from an adversarial perspective and has featured numerous videos by social commentator Mark Dice which lambaste the shopping spectacle as a sad reflection of how American values have come to represent little more than mindless consumerism.

Given some of the other activities which the federal government has linked with terrorism, it’s unsurprising that consumer boycotts are also being treated as a potentially violent threat, underscoring about how paranoia about domestic terrorism is having a huge a chilling effect on the First Amendment.

Former Florida Representative and retired Army Colonel Allen West has always been an outspoken critic of the President, his misguided policies, and his unconstitutional and criminal actions.

He has called President Obama a liar and a disgrace, has accused him of “potential treason” in Benghazi, and has called for his impeachment because he has broken his oath of office.

West is speaking out again, this time regarding the prisoner swap that Obama orchestrated that provided material support to the Taliban by releasing five of their most dangerous guys, in direct violation of a law that required Congressional approval first.

Allen West is calling for the House of Representatives to draw up Articles of Impeachment over Obama’s handling of the prisoner swap for the missing, and presumed deserter, Sgt. Bowe Bergdahl, according to the Washington Times.

“We acquiesced to the demands of a terrorist organization,” he said, Breitbart first reported. “Without a doubt, this is an impeachable offense. This represents aiding and abetting the enemy, this is a high crime and misdemeanor, and the United States House of Representatives should draw up articles of impeachment on the president on this incident.”

West also addressed claims by National Security Adviser Susan Rice that Bergdahl served “with honor and distinction”.

“Desertion in a combat operation is a credible, punishable offense, and they’re going to have to bring those charges up against Bergdahl,” Mr. West said in the interview. “There is no way we can trust Susan Rice. … She is a delusional liar, that’s the only thing you can say.”

Of course Allen West is right.  This is just the latest example of why Barack Obama is a “domestic enemy” who must be impeached.

Former prosecutor Andrew McCarthy recently released a book that lays out the political and legal case for drawing up Articles of Impeachment against Obama.  Perhaps he will have to go back and add a postscript about this gross violation of the law that has released dangerous terrorists back into the world to kill again.

The National Security Agency is collecting vast numbers of images sent by individualscommunicating via text messages, emails, social media, and other communications, according to the latest documents released by NSA whistle blower Edward Snowden. From The New York Times:
The National Security Agency is harvesting huge numbers of images of people from communications that it intercepts through its global surveillance operations for use in sophisticated facial recognition programs, according to top-secret documents.
The spy agency’s reliance on facial recognition technology has grown significantly over the last four years as the agency has turned to new software to exploit the flood of images included in emails, text messages, social media, videoconferences and other communications, the N.S.A. documents reveal. Agency officials believe that technological advances could revolutionize the way that the N.S.A. finds intelligence targets around the world, the documents show. The agency’s ambitions for this highly sensitive ability and the scale of its effort have not previously been disclosed.
The agency intercepts “millions of images per day” — including about 55,000 “facial recognition quality images” — which translate into “tremendous untapped potential,” according to 2011 documents obtained from the former agency contractor Edward J. Snowden. While once focused on written and oral communications, the N.S.A. now considers facial images, fingerprints and other identifiers just as important to its mission of tracking suspected terrorists and other intelligence targets, the documents show.

Tens of thousands of people held a candlelight vigil in Hong Kong to mark the bloody crackdown on pro-democracy protesters 25 years ago in Beijing's Tiananmen Square, while mainland China sought to censor any mention of the 1989 event.

Demonstrators holding candles and clad mainly in black, gathered in a downtown park in Hong Kong on Wednesday, and called on Beijing to atone for the killings.

Organisers said some 180,000 people took part of the event in the former British colony, which returned to Chinese rule in 1997 but remains a free-wheeling, capitalist hub.

This event must be instilled in everyone's heart. We can't let time dilute this.

People bowed to pay their respects as footage of the clampdown was shown on large screens.

"This event must be instilled in everyone's heart. We can't let time dilute this," said 19-year-old student Anna Lau.

A large number of mainland Chinese also flocked to commemorate the crackdown in the city-state territory, where a vigil has been held every year since the massacre.

"Hong Kong is a free society where you can speak out. In China, the Communist Party dictates everything," said Chen Jing Gen, in his 60s, who travelled from the southern Chinese city of Shenzhen to attend the vigil.

"People in mainland China are mostly aware of June 4, but due to the control of the Party no one dares to talk about it," Chen added.

Al Jazeera's Rob McBride, reporting from Hong Kong, said: "It is an annual event here to keep alive symbolically the flame of democracy that was lit 25 years ago. People here think they have a bond with those students who came out in Tiananmen Square all those years ago."

Beijing on alert

In Beijing, police flooded the streets around the square, scene of the worst of the violence a quarter of a century ago, and censors scrubbed the internet clean of any mention of the rare open display of defiance against the Communist Party.

Dozens of riot police and police patrol cars could be seen parked around the square, as well as at intersections several blocks away on the avenue of Eternal Peace.

"This time 25 years ago today you could not enter Tiananmen Square as a journalist. And 25 years on you still can't," said Al Jazeera's Adrian Brown, reporting from Beijing.

"This really is a reflection of the official nervousness for this very sensitive anniversary. They are trying to erase all public memory of what happened here 25 years ago."

Despite the date's sensitivity, operations at the square seemed to resume as they would on a normal day in Beijing.

'Internal affairs'

The United States led international calls for China to account for what happened on June 4, 1989.

Remembering Tiananmen

The comments riled China, which has said the protest movement was "counter-revolutionary".

"We demand the US side respect China's judicial sovereignty and not make irresponsible comments on issues that are related to China's internal affairs," Chinese foreign ministry spokesman Hong Lei told a regular news conference in Beijing.

Exiled Tibetan spiritual leader the Dalai Lama also used the anniversary to call on China to embrace democracy.

China has never released a death toll from the crackdown after troops shot their way into central Beijing, but estimates from human rights groups and witnesses range from several hundred to several thousand.

China also prohibits public discussion of the events, leaving many of the country's youth ignorant of what happened.

"I had never heard of the Tiananmen incident until I was studying in the United States when I was 18," said a 25-year-old woman surnamed Lan, who was visiting Hong Kong from Beijing.

Activists and commentators in the mainland said the country's determination to quell any mention of the event was especially strong this year, and authorities had made mass arrests just before the anniversary.

Rights group Amnesty International said 48 people had been detained, placed under house arrest, questioned by police or had gone missing ahead of the anniversary.

Police have also warned foreign reporters from visiting "sensitive places" and prevented them from interviewing people on the topic.

The US Navy has announced it will soon give its “final” assessment on whether land they plan to sell to the City of San Francisco for development is still contaminated with radiation.

Since 1993, the Navy has attempted to convince the city to buy back Treasure Island, a decommissioned naval base located in San Francisco Bay. Once acquired, the city can sell the land to developers who have long envisioned building a $1.5 billion, 20,000 resident high-rise community.

“It’s going to be one of the premiere addresses in San Francisco,” the Director of the Treasure Island Development Authority says prospectively.

But before the Navy can unload the property, it has to prove the island’s safety to city and state health departments.

The problem is this will be the Navy’s second “final” assessment, after a 2006 investigation conducted by an independent contractor failed to turn up various radiological hot spots.

And the Navy’s cleanup efforts have done little if any good, with many alleging they’ve actually done more to widen the spread of contamination.

Decontamination training, radium spill, radioactive shards

Treasure Island has a serious radiological history. The 403-acre piece of real estate was constructed to house the 1939 Golden Gate International Exposition, but was seized in 1942 by the Navy for the war effort.

The site served to train Navy personnel for radiological operations as early as 1947, and berthed ships the Navy swears were surveyed and decontaminated at other shipyards. However, a mock ship, the USS Pandemonium, used for decontamination training remained continually docked there.

“Decontamination involved spraying and scrubbing the surfaces of the mockup with water and detergent to wash away the radioactive contamination,” the 2006 assessment states, insisting that only short-lived isotopes were used for training.

In 1950, radium spilled inside one of the facility’s labs. The report noted the failure to properly quarantine: “Since many of the occupants of Building 233 left the building before the extent of the spill was fully identified, radioactive contamination was carried by personnel (on shoes, clothing etc) to personal automobiles and personal residences.” Newspapers at the time also described “traces of radium” “were tracked into homes widely scattered throughout the bay areas.”

Cleanup consisted of radioactive waste being loaded into 200 barrels and dumped off the coast “weighted with concrete and.. sunk at sea at a depth of more than 100 fathoms.”

The 2006 report, entitled “Final Treasure Island Naval Station Historical Radiological Assessment,” is now, however, regarded as largely erroneous after contractors hired by the Navy continued turning up radiation in areas that were supposed to be safe.

“One civilian cleanup worker was ordered off the job with pay after being exposed to the maximum radiation dosage allowed under Nuclear Regulatory Commission guidelines, Sullivan, the Navy environmental cleanup coordinator, acknowledged,” reported Matt Smith for the Bay Citizen.

Further investigation revealed Treasure Island to have a larger radiological history than previously disclosed. “It included a repair shop for gun sights, which sometimes contained glowing markers made of radioactive elements,” Smith wrote. Also, “Researchers found indications that ships that berthed there could have been contaminated with radiation from Pacific nuclear bomb tests.” The report also neglected to mention the facility housed a “counting room,” suggesting the Navy suspected contamination of personnel and equipment.

The Navy came under further scrutiny in 2010, after a state public health official alleged that “Navy contractors had dug up and hauled off 16,000 cubic yards of contaminated dirt, some with radiation levels 400 times the Environmental Protection Agency’s human exposure limits for topsoil.” “And worse,” notes Zero Hedge, “radioactive material in the soil around those excavations exposed children at a Boys & Girls Club and a child development center to contaminated dust.”

In 2011, the state health department’s radiological health enforcement specialist issued the Navy and its cleanup contractor a violation notice, accusing them of “repeatedly digging, piling, spreading and transporting dirt from sites contaminated with toxic chemicals” without proper testing, “potentially spreading radiation beyond its original location,” according to Smith.

Despite cleanup efforts, radioactive debris has been discovered as early as last year. A report filed by the state Public Health Department revealed radioactive shards were found in people’s lawns and “could represent a hazard to children.”

“One small octagonal object was so hot that holding onto it for an hour could cause radiation burns, hair loss and possible ulceration, according to the memo,” Matt Smith reported. “Regulators have speculated that the shards might have been buried in the soil decades ago to train sailors to use Geiger counters, which measure radiation.”

Residents develop various illnesses

Some of the island’s 2,000 residents say the Navy knowingly misled them. “They should have been more open and upfront, because there would have been people who would have chosen not to live here,” one former resident told the Bay Citizen.

Other island inhabitants maintain living there made them sick. From the East Bay Express:

According to [former resident Brenna] Summers, her sister Misty, who was seven when their family came to Treasure Island, had an emergency hysterectomy at age eighteen to remove a pre-cancerous mass from her uterus, fallopian tubes, and ovaries. Her other sister, Heather, was pregnant while living on the island; Heather’s son was born with birth defects. Summers’ children were later born with birth defects as well. Summers’ mother and sister Misty survived skin cancer; her brother Brian had a pre-cancerous growth removed from his face. Everyone in the family has suffered some form of autoimmune disease. All the pets the family owned or took care of while living on the island — including eight dogs and three cats — died of cancer. With the exception of one cat, all the pets died between the ages of one and six years old.

Another former resident believes radiation is responsible for many of her friends’ cancers and that her own breast cancer was a result of living there:

Needless to say, residents have grown weary of the Navy’s reassurances, but the department continues declaring the island safe.

“We believe there’s no public health hazard,” Laura Duchnak, Director of the Navy Base Realignment Closure Program, recently told CBS San Francisco.

The Navy expects the latest round of testing will only take up to three months, after which, CBS San Francisco claims, residents will know “for sure if it is safe to stay there.”
